CRASH INVESTIGATION NEEDED
Despite widespread campaigns warning of the dangers of impaired driving, people continue to make the reckless choice to drink and drive—putting countless lives at risk. According to Mothers Against Drunk Driving (MADD), someone is killed or injured in a drunk driving crash every 85 seconds in the United States.
An independent investigation will be necessary to determine all contributing factors in the collision, including the results of any blood-alcohol content (BAC) tests performed on the driver.
Candice Bond, an experienced DUI accident attorney and Managing Partner at Bond Legal, weighed in on the incident.
“Serving as an advocate, an attorney can help compassionately guide a victim or their family during this difficult time—protecting their legal rights while ensuring that drunk drivers are held accountable for their reckless actions,” said Bond.
WRONGFUL DEATH CLAIM
Pending the results of the investigation, the family members of the victim killed in the crash may be entitled to a wrongful death claim. Such claims may seek compensation for funeral and burial expenses, loss of love and companionship, emotional distress, and other related damages.
“An incident is considered a wrongful death when either a person or entity commits a negligent or wrongful act that results in someone’s death,” said Candice Bond, Managing Partner of Bond Legal and a national legal analyst.
“When fatal crashes involve factors such as impaired driving, speeding, or reckless behavior, grieving families are often left with the option to pursue a civil action to hold the responsible party accountable and recover damages for their profound loss.”
