Police: Avina Struck and Killed Pedestrian at Atlanta Ave and Delaware St
HUNTINGTON BEACH, CA, (July 06, 2025) - A 35-year-old man was tragically struck and killed by a suspected drunken driver early Sunday in Huntington Beach.
A 35-year-old man was tragically struck and killed by a suspected drunken driver early Sunday in Huntington Beach. Nathan Ethan Avina was arrested in connection with the fatal crash.
Police say the incident occurred around 12:45 a.m. at the intersection of Atlanta Avenue and Delaware Street, where the victim was hit by an Audi RS5 driven by Nathan Ethan Avina. The pedestrian, whose identity has not been released, was pronounced dead at the scene.
Avina was arrested at the scene on suspicion of driving under the influence. The crash remains under investigation.
FATAL PEDESTRIAN CRASH INVESTIGATION
Intoxicated drivers frequently strike pedestrians due to alcohol’s dangerous effects—impaired judgment, delayed reaction time, and reduced coordination—all of which hinder a driver’s ability to respond to traffic conditions and avoid tragic collisions.
In 2023, a staggering 12,429 people were killed in alcohol-impaired driving crashes across the U.S. In California alone, 1,479 people lost their lives in such incidents in 2022, according to the California Office of Traffic Safety.
“These crashes share a tragic truth: they were entirely preventable,” said Candice Bond, Managing Partner at Bond Legal and a national legal analyst. “Driving under the influence endangers everyone on the road.”
Bond stressed that, in addition to criminal proceedings, the families of victims may pursue justice through civil litigation. “Separate from criminal charges, a victim’s family may be entitled to compensation through a civil lawsuit against the responsible party,” she said. “Serving as an advocate, an attorney can help compassionately guide grieving families during this difficult time, protecting their legal rights while ensuring that drunk drivers are held accountable for their reckless actions.”
WRONGFUL DEATH CLAIM
The family members of the pedestrian killed in this accident may be entitled to pursue a wrongful death claim. Surviving loved ones of wrongful death victims can seek compensation for the loss of companionship, emotional distress, pain, and suffering caused by such a tragic event.
“We understand just what families are forced to go through, and having their rights protected is vital,” said Candice Bond, Managing Partner at Bond Legal. “A wrongful death lawyer will stay updated on the official investigation and help ensure that their best interests are taken care of. Relatives of wrongful death victims are entitled to seek damages for the loss of companionship, pain and suffering, and emotional distress following a tragic or catastrophic accident.”
