FATAL HIT-AND-RUN ACCIDENT INVESTIGATION
The GSP Specialized Collision Reconstruction Team (SCRT) is assisting with the ongoing investigation.
While it is almost always a driver’s duty to yield to any pedestrian, those on foot still face everyday dangers in this country. In fact, in Georgia, pedestrian fatalities have nearly doubled in the last decade, with 345 deaths in 2022, according to the Georgia Governor's Office of Highway Safety. Data from 2022 shows 345 pedestrians were killed in motor vehicle traffic crashes.
“In most instances, pedestrians possess the right of way when crossing an intersection or a street regardless of if they are in a marked crosswalk,” said Candice Bond, an experienced pedestrian accident attorney.
Bond, Managing Partner of Bond Legal, noted in cases such as this that it's imperative to have an independent probe conducted by a seasoned lawyer to help protect the family of a victim’s rights.
“Having the proper resources is extremely important in order to investigate a pedestrian accident case and prove negligence,” Bond added. “Road conditions, signage visibility, and road lighting are all possible contributing factors that are considered and must be thoroughly examined. These procedures are necessary for helping those who have lost a loved one receive the justice that they deserve.”
WRONGFUL DEATH CLAIM
Pending the outcome of the investigation, the family of Gerardo Andrade De La Cruz may be entitled to pursue a wrongful death claim. Family members can seek damages for loss of companionship, funeral expenses, pain and suffering, and emotional trauma.
“The loss of a loved one in an accident is profoundly overwhelming,” said Candice Bond, Managing Partner at Bond Legal. “It is crucial to protect a family’s rights during this difficult time. A wrongful death attorney will closely monitor the investigation and advocate to ensure the family’s legal rights and best interests are fully safeguarded.”
