An 81-year-old woman was taken to a hospital with life-threatening injuries, state patrol says
MOFFAT, CO, (December 05, 2024) - The Colorado State Patrol says a crash involving a semi-truck left two people dead and injured another on Thursday afternoon along U.S. Highway 40 in Moffat County.
Ervin Gerber, 85, and his daughter-in-law Ashley James, 57, lost their lives Thursday afternoon when a semi-truck crashed into their vehicle along U.S. Highway 40 in Moffat County, the state patrol said.
The fatality victims have been identified as Ervin Gerber, age 85, and his daughter-in-law Ashley James, age 57.
According to preliminary findings, a Subaru carrying three people—including Gerber from Craig and Minnesota resident James—was traveling westbound near mile marker 81, and around 3:11 p.m., its driver attempted to make a left turn onto a private driveway. That is when an eastbound semi-truck crashed into the Subaru's passenger side, causing both vehicles to travel off the roadway and into a field.
An 81-year-old woman behind the wheel of the Subaru was transported to the hospital with life-threatening injuries, officials said.
The state patrol is investigating.
CRASH INVESTIGATION NEEDED
Candice Bond, an experienced tractor-trailer accident attorney, said that in such cases, it is imperative to have an independent investigation conducted promptly to protect the rights of a victim.
“Tractor-trailer crashes are often complex, and many factors can play a role in these types of accidents,” said Bond, a Managing Partner of Bond Legal.
“A skilled attorney can protect victims from trucking companies, which often send their investigators to crash sites and possess a variety of resources they can utilize to defend a negligent truck driver.
“Your lawyer can advocate for you by hiring expert witnesses, conducting driver background checks, locating witnesses to the crash, and reviewing applicable insurance coverage while carefully guiding a victim through the legal process.”
WRONGFUL DEATH CLAIM
The family of Ervin Gerber and Ashley James may pursue compensation for damages such as costs associated with the death, loss of income and companionship, and other hardships.
“A death to a family member after an accident is both tragic and devastating to a surviving family. The grief, shock, and anger can be overwhelming,” said Bond, who is also a national legal analyst for Newsline.
She added, “Aside from the emotional suffering of those left behind, the death of someone close can have devastating financial implications.”
