Legal Insights

In cases such as this involving suspected impaired driving, thorough investigations are essential to uncover all elements, including driver impairment levels.

“Serving as an advocate, an attorney can help compassionately guide a victim during this difficult time, protecting their legal rights while ensuring that drunk drivers are held accountable for their reckless actions,” said Candice Bond, managing partner of Bond Legal.

Key takeaways from legal perspectives on motor vehicle crashes:

  • Preserve evidence promptly to establish fault and impairment.
  • Families may pursue claims for losses like medical costs, funeral expenses, and emotional distress.
  • Civil actions often target negligent drivers responsible for unsafe behaviors such as speeding or distraction.

“An incident is considered a wrongful death when either a person or entity commits a wrongful or negligent act resulting in a person's death,” said Stefano Formica, of counsel with Bond Legal. “When vehicle accident fatalities result from unsafe driving, aggressive or distracted driving, speeding, or driving under the influence, family members are usually left with the option to pursue a civil action against the responsible motorist.”

Pending results, Lynn's family could explore options for compensation covering pain, suffering, and companionship loss.
