FATAL PEDESTRIAN ACCIDENT INVESTIGATION
While drivers are typically required to yield to pedestrians, those on foot continue to face serious risks on U.S. roadways. From 2010 to 2019, pedestrian fatalities rose by a staggering 45 percent nationwide, highlighting the growing danger for those walking near traffic.
“In most instances, pedestrians possess the right of way when crossing an intersection or street, even if they are not in a marked crosswalk,” said Candice Bond, Managing Partner at Bond Legal and a national analyst for Newsline.
Bond emphasized the importance of conducting an independent investigation in cases like this to protect the rights of the victim’s family.
“Having the proper resources is crucial to thoroughly investigate a pedestrian accident and prove negligence,” she said. “Factors such as road conditions, signage visibility, and street lighting must be carefully examined. These steps are essential in helping families pursue justice after such a devastating loss.”
WRONGFUL DEATH CLAIM
Pending the results of the investigation, the family of Logan James Irwin may be entitled to pursue a wrongful death claim. Such claims may include compensation for the loss of love and companionship, funeral expenses, emotional distress, and pain and suffering.
“The stress and sorrow can be extremely overwhelming after losing a loved one in an accident,” said Candice Bond, Of Counsel with Bond Legal. “We understand just what families are forced to go through, and having their rights protected is vital. A wrongful death attorney can closely monitor the investigation and help ensure the family's legal rights and best interests are safeguarded.”
