Legal Insights on Pedestrian Accidents

“In most instances, pedestrians possess the right of way when crossing an intersection or a street regardless of if they are in a marked crosswalk,” said Candice Bond, managing partner at Bond Legal.

Bond, stressed the need for an independent investigation by an experienced attorney to safeguard the family’s rights in cases such as this. She added that time is critical to preserve evidence effectively.

“It is almost always a driver’s duty to yield to any pedestrian,” said Stefano Formica, of counsel with Bond Legal.

Formica, explained that families may pursue wrongful death claims for losses including income, companionship, funeral costs, and emotional distress. He warned that insurers may push for low settlements, but a lawyer can fight for fair compensation.

Takeaways from legal analysts:

  • Conduct a thorough, independent review of the incident
  • Act quickly to secure evidence
  • Understand potential wrongful death recovery options
  • Avoid premature insurance settlements
