CRASH INVESTIGATION NEEDED

Pedestrian fatalities are on the rise across the United States, with 2,304 lives lost in the first half of 2024 alone, according to a recent report from the Governors Highway Safety Association (GHSA). These deaths, experts stress, are largely preventable.

“In most instances, pedestrians possess the right of way when crossing an intersection or a street, regardless of whether they are in a marked crosswalk,” said Candice Bond, a seasoned pedestrian accident attorney and Managing Partner at Bond Legal.

Bond emphasized the importance of vigilance behind the wheel and called for independent investigations in fatal pedestrian collisions. “It’s imperative to have an independent probe conducted by a seasoned lawyer to help protect the rights of the victim’s family,” she said.

Advocates continue to urge both increased driver awareness and infrastructure improvements to help reduce these preventable tragedies.

WRONGFUL DEATH CLAIM

Following the tragic death of Jose Rodriguez, a 63-year-old pedestrian struck and killed in Rosemead, legal experts say his family may have the right to pursue a wrongful death claim.

“It is almost always a driver’s duty to yield to any pedestrian,” said Stefano Formica, of counsel at Bond Legal. “Family members of wrongful death victims may seek damages for loss of income and companionship, pain and suffering, funeral expenses, and emotional distress following a tragic or catastrophic accident.”

Formica also warned that insurance companies may attempt to settle quickly for less than a case is worth. “An attorney will vigorously advocate for their client to ensure that they are treated with respect and compensated fairly,” he added.

The incident remains under investigation.
