Monday afternoon collision happened along E. Second Street
DULUTH, MN, (October 28, 2024) - A Duluth Police Department vehicle struck and injured a pedestrian on Monday afternoon, according to the Minnesota State Patrol.
Jessica Deloney was injured on Monday when she was struck by a Duluth police car along E. Second Street in the East Hillside neighborhood.
Officer Amy Alden Lemenager, age 26, was driving the squad car east on E. Second Street, intending to turn left onto Sixth Avenue E in the East Hillside neighborhood, when the incident occurred at around 1:20 p.m.
The pedestrian, 47-year-old Jessica Ann Deloney of Duluth, was transported to Essentia Health-St. Mary's with non-life-threatening injuries.
MSP confirmed that Lemenager was on duty at the time of the crash, but no emergency equipment such as lights or sirens were activated.
The investigation is being led by MSP.
PEDESTRIAN ACCIDENT INVESTIGATION
The statistics are staggering: Approximately 6,227 pedestrians died in the U.S. in 2018, and even more were injured, an increase of 250 from a year earlier, according to the Governors Highway Safety Association.
This incident underscores the dangers that pedestrians face every day in this country. The cause of many of these accidents is negligent driving, distracted driving, or drivers failing to yield to pedestrians.
“Having the proper resources is extremely important to investigate a pedestrian accident case and prove negligence,” said Candice Bond, an experienced pedestrian accident attorney and a Managing Partner with Bond Legal.
“An examination of road conditions, signage visibility, and road lighting is crucial. These procedures are necessary for helping those who have lost a loved one receive the justice that they deserve.”
PERSONAL INJURY CLAIM
Jessica Deloney may have the right to pursue a personal injury claim pending an investigation.
Bond said, “Injured victims involved in a collision often seek a personal injury claim to cover the cost of medical bills, future medical care, loss of income, emotional trauma, and pain and suffering.
"Insurance companies can be notoriously unconcerned with the mounting costs that an injured party may accrue. An attorney can help. We protect the victims of these tragedies daily, forcing the insurance companies to pay for their mistakes,” she added.
