Why Do Pedestrian Accidents Happen?

Pedestrian crashes in Alabama and nationwide often stem from factors like driver distraction, poor visibility, and vehicle blind spots. According to Drive Safe Alabama, most fatal pedestrian incidents occur at night, with urban areas seeing more crashes but rural roads claiming more lives.

The Governors Highway Safety Association notes a national rise in pedestrian deaths, up nearly 60% since 2013, partly due to larger vehicles like SUVs and pickups obstructing views.

Legal Insights

In cases such as this involving pedestrian collisions, road conditions, visibility, and lighting play critical roles, according to national legal analyst Candice Bond, managing partner at Bond Legal.

“An accident reconstruction team is sometimes needed to help piece together what happened. All of these resources are necessary for helping clients receive monetary compensation for damages or a loss following a collision,” said Bond.

Key takeaways from analyst perspectives:

  • Drivers must yield to pedestrians in nearly all scenarios.
  • Families may pursue claims for lost income, companionship, pain and suffering, funeral costs, and emotional distress.
  • Legal representation ensures fair treatment against insurance pressures for low settlements.

Stefano Formica, of counsel with Bond Legal, added:

“Insurance companies often try to pressure victims to settle for a quick payout for far less than the case is worth. However, an attorney will vigorously advocate for their client to ensure that they are treated with respect and compensated fairly.”
