Why Do These Accidents Happen?

Winter road conditions often contribute to loss-of-control incidents, particularly when drivers encounter unexpected snow or ice. Factors like speed, visibility, and failure to adjust for weather play key roles.

The Insurance Institute for Highway Safety (IIHS) notes that pedestrian-involved motor vehicle crashes have seen fatalities rise by 78%, now comprising 18% of all crash deaths.

Legal Insights

National legal analysts emphasize the need for thorough investigations in pedestrian collision cases to establish fault and support recovery for those affected.

“Staying vigilant, maintaining safe speeds—especially in winter with slick conditions—and obeying pedestrian rules can prevent many such tragedies,” said Candice Bond, managing partner at Bond Legal.

Key takeaways from analyst perspectives in cases such as this:

  • Pedestrians typically hold the right-of-way at intersections or streets, even outside marked areas, and drivers must yield.
  • Elements like road conditions, signage, and lighting require detailed review to identify negligence.
  • Proper investigation helps secure justice for injured parties.

“Those hurt in collisions may pursue claims for medical expenses, lost wages, ongoing care, and emotional distress,” said Stefano Formica, of counsel with Bond Legal. “Insurance providers often resist full compensation, and legal guidance ensures accountability.”
