August 26, 2024 | San Benito, CA
A San Jose trucker was killed in a head-on collision involving two big rigs near the Santa Clara-San Benito county line Monday morning, according to authorities.
The incident happened around 10 a.m. on State Highway 25 south of Bolsa Road.
A 68-year-old San Jose resident lost his life in a head-on collision involving two tractor trailers near the Santa Clara-San Benito county line Monday morning, officials said.
A preliminary report by the California Highway Patrol found that a 2017 Freightliner Cascadia was traveling northbound when, for unknown reasons, the driver veered into the southbound lanes and collided with a 2022 Mack Anthem. After the crash, both big rigs came to a rest on the west shoulder with their trailers in the southbound lane.
The 68-year-old driver of the Mack died from injuries, according to the Santa Clara County Medical Examiner-Coroner’s Office.
The Cascadia's driver, Amarjit Singh Pajwa, 70, was hospitalized with major injuries.
No other details were available.
CRASH INVESTIGATION NEEDED
According to the Federal Motor Carrier Safety Administration (FMCSA), driver-related factors were recorded in 2,554 of the 7,368 (34.7 percent) fatal semi-truck crashes during a recent two-year period.
Candice Bond, an experienced semi-truck crash attorney, noted that investigations into semi-truck crashes require various resources.
Representing a grieving client’s family, an attorney can investigate the accident scene, closely examine the rig, the truckers, and the trucking company’s logbooks and other records to preserve evidence.
“Tractor-trailer crashes are often complex, and many factors can play a role in these types of accidents,” said Bond, Managing Partner of Bond Legal.
WRONGFUL DEATH CLAIM
Pending the investigation, the family members of the 68-year-old San Jose man may be entitled to a wrongful death claim. Family members of wrongful death victims may seek damages for loss of companionship, pain and suffering, and emotional distress following a catastrophic accident.
“The stress and sorrow can be extremely overwhelming after losing a loved one in an accident,” said Stefano Formica, Of Counsel with Bond Legal.
“A wrongful death lawyer will stay updated on the official investigation and help ensure that the victim's legal rights and best interests are protected.”
